Privacy Policy

1. Introduction

Welcome to CheersCount ("the App"). We respect and protect your privacy. This Privacy Policy explains how we collect, use, store, and disclose information from users of our App in compliance with applicable European Union (EU) data protection regulations (GDPR) and Austrian law.

2. Age Requirement

The App is intended only for individuals who are 18 years of age or older. Before you can use it, the App asks you to confirm that you meet this age requirement. We store only the time of that confirmation, never your date of birth. If you answer that you are under 18, nothing is stored about the answer and the App offers to delete the data saved so far. The App does not encourage alcohol consumption at any age; it exists to make the effects and risks of alcohol visible.

3. Personal Data We Collect

We collect the following data when you use CheersCount:

Account Information

Name (may be provided through social login or manually).
Google Sign-In – if you sign in with Google, we only receive the basic profile data (name, email address, profile picture) you choose to share with us.
Email sign-in – if you sign in with your email address, we store that address and send it a one-time sign-in code through our email delivery provider (Resend).
Without an account – you can also use the App without signing in. We then store your data under a random identifier, without asking for your name or email address.
Age confirmation – the time you confirmed being 18 or older (see section 2).

Physical Information

Weight, Height and Gender for purposes of estimating blood alcohol concentration (BAC).

Usage Data

Drink Consumption Records (type of drink, alcohol volume, quantity).
Friend Connections (usernames/emails you connect with).

Analytics

We use Rybbit Analytics, an analytics tool we host ourselves in the EU, to collect aggregated usage data (such as pages visited and feature interactions) to improve our services. It sets no cookies and stores no identifier on your device, and usage is not linked to your account, your email or your name. No advertising profile is built and no data is shared with advertising networks. You can turn analytics off in Settings. We additionally use a self-hosted error-tracking service to record technical error reports.
What we deliberately do not send. Page addresses that identify a specific session, friend, hangout or chat are masked before they are recorded, and invite, claim and recap links have their codes removed from the address entirely. Drink events are reported only as a fixed category such as “beer” or “spirit” — never the name you gave a drink or a template, since a name you typed yourself could identify you.
Why the marketing site has no separate toggle. The analytics toggle in Settings covers this app. On cheerscount.com, the public marketing site, the same self-hosted tool records anonymous page visits only: there is no account there, no identifier is stored on your device, and the toggle would have nothing to switch off. Turning analytics off in the app therefore does not, and does not need to, carry over to the marketing site.

4. How We Use Your Data

1. Account Creation and Authentication: We use your provided information to create and secure your account.

2. BAC Calculation: We use weight, height, gender, your logged drinks and meals, and any breathalyzer readings you choose to enter (which personalise how quickly the estimate falls) to provide an estimated BAC. This result is not medically accurate and is provided for general informational purposes only.

3. Sharing with Friends: If you choose, you can share your consumption statistics with your added friends.

4. Analytics and Improvements: We analyze usage data to maintain, improve, and customize the App.

5. Personal Messages from the Developer: If your account has an email address, the developer may write to you personally, rarely, to ask how the App is working for you or to answer a question you raised. These are individual messages, not a mailing list: they contain no advertising, no tracking, and are not sent through our email delivery provider. Reply "stop" and you will not be written to this way again.

5. Legal Basis for Processing

Under GDPR, we process your personal data based on:

Consent: By creating an account or providing optional data, you consent to our processing activities.
Legitimate Interests: To ensure the App functions properly, to personalize your experience, to secure our service, and to ask existing users how it is working for them.

6. Data Storage and Security

We store your data on servers we run ourselves at Hetzner Online in Nuremberg, Germany (European Union), our hosting provider.
We implement appropriate technical and organizational measures to protect your data against unauthorized access, loss, or alteration.
Although we take security seriously, no method of online storage or transmission is 100% secure.

7. Data Sharing

Friend Connections: If you opt to connect with another user (by username or email), certain statistics (e.g., number of drinks, type of drinks) may be visible to them.
Service Providers: Aggregated usage data is processed by our self-hosted Rybbit Analytics instance to help us understand App performance and improve user experience. Payment processing is handled by our payment providers (Google Play Billing / Stripe); we never see your full payment details.
Email Delivery: If you sign in with an email code, your email address and that code are passed to Resend (Resend, Inc.), our transactional email provider, for the sole purpose of delivering that one message. We use their EU processing region. We send no marketing email and Resend is not used for one.
Sign-in with Google: If you sign in with Google, Google confirms your identity to us. We receive your name, email address and profile picture; Google learns that you signed in to CheersCount.
Push notifications: If you turn on notifications, they are delivered through the push service of your browser or device maker (such as Google Firebase Cloud Messaging, Mozilla or Apple). The message is encrypted for your device, so the push service passes it on without being able to read it, and it receives no account data.
Venue suggestions: If you use venue suggestions for a session, the position of your device (or the text you type into the search) is sent through our server to a geocoding server (Photon, based on OpenStreetMap) that a third party operates for us in Austria. It receives only that position or search text, nothing that identifies you, and does not keep logs of the requests.
Barcode lookup: If you scan a drink's barcode, our server asks Open Food Facts for that product. Only the barcode is sent.
Legal Compliance: We may disclose your data if required by law or to enforce our legal rights.

8. User Rights (GDPR)

As an EU resident, you have the right to:

Access: Request a copy of the personal data we hold about you.
Rectification: Request corrections to any inaccurate or incomplete personal data.
Erasure: Request deletion of your data.
Restriction: Request restriction of processing under certain circumstances.
Data Portability: Receive your personal data in a structured, commonly used, and machine-readable format.
Objection: Object to processing of your personal data under certain conditions.

9. Data Retention

We retain your data for as long as your account is active or as needed to provide services. If you request deletion, we will remove or anonymize your data in accordance with our retention policies and legal requirements.

10. Cookies & Tracking Technologies

We do not use cookies for advertisement or marketing.
Our analytics tool (Rybbit Analytics) is cookieless; usage is linked only to an opaque account identifier stored in your browser's local storage, not via advertising cookies. A session cookie is used solely to keep you signed in.

11. BAC Disclaimer

Our BAC estimation tool is not a substitute for professional advice, medical testing, or legal breathalyzer devices. Various factors (e.g., food intake, metabolism, health conditions) affect actual BAC. You should never rely solely on the App's BAC estimate to decide whether you are fit to drive or conduct any potentially hazardous activity.

12. Changes to This Privacy Policy

We reserve the right to update or modify this Privacy Policy at any time. If we make significant changes, we will notify you through in-app prompts or email (if provided). Your continued use of the App after such changes indicates your acceptance of the revised policy.
