1. Acceptance of Terms
By downloading, installing, or using the CheersCount App ("the App"), you
agree to these Terms of Service and our Privacy Policy. If you do not agree, you must discontinue use of
the App.
2. Age Restriction
- You must be 18 years or older to use this App.

The App asks you to confirm this before you can use it, whether you sign in or continue as a guest.
By confirming, you declare that you meet this age requirement. If you are under 18, you must not use
the App.

The App does not encourage alcohol consumption. You are responsible for complying with the legal
drinking age and all other laws that apply in your country.
3. Responsible Use and Disclaimer

Drinking Responsibility: You agree to use the App responsibly and
understand the App is only a tool to track and raise awareness of alcohol consumption. It does
not provide medical advice.

Not a Medical Device: CheersCount is not a medical device and does
not diagnose, treat, cure, or prevent any medical condition. Consult a healthcare professional for
medical advice, diagnosis or treatment.

BAC Estimation: Any BAC calculation provided by the App is an
estimate based on the information you provide. This estimate is
not guaranteed to be accurate. Under no circumstances should you
drive or engage in dangerous activities based on this estimate alone.

Health and Safety: Always consider other factors (such as food
intake, medical conditions, etc.) and consult a professional if you have any concerns about your
health or alcohol consumption.
4. User Accounts
1. Registration: You register an account by signing in with your
Google account (Google Sign-In) or with a one-time code sent to your email address. You can also use
the App without an account; its data then stays tied to that device and browser until you create an
account.
2. Account Security: You are responsible for maintaining the
confidentiality of your login credentials and for all activities that occur under your account.
3. Personal Data: Some personal information (name, weight, height,
gender, etc.) is optional but can improve App features such as BAC calculations.
5. Subscriptions and In-App Purchases

Paid Plans: The App offers recurring monthly/yearly subscriptions and
a non-renewing lifetime purchase. Lifetime is a one-time payment, not a subscription, and is offered
only to accounts that are Free or in their trial at checkout.

Cancellation: You can cancel a subscription at any time, but it will
remain active until the end of the current billing period.

Payment Providers: Android in-app purchases are processed by Google
Play. Web, desktop and iOS-browser purchases are processed by Stripe. Charges, taxes, regional
pricing, payment methods, refunds and disputes are also subject to the applicable provider's terms.

Management and Refunds: Recurring plans are managed with the provider
that sold them. Lifetime has no recurring cancellation. A refunded or voided lifetime purchase loses
premium access; Stripe may suspend access while a dispute is open, restore it if the dispute is won,
or revoke it if the dispute is lost.
6. Friends and Sharing

You can connect with other users by adding them via their username or email, upon mutual consent.

By connecting with friends, you agree to share certain statistics (e.g., number of drinks, type of
drinks) as configured in your account settings.
7. Intellectual Property

Ownership: All content, features, and functionality in the App
(including text, graphics, logos, etc.) are owned by or licensed to
CheersCount.

Restrictions: You may not reproduce, distribute, modify, or create
derivative works without explicit written permission.
8. Limitation of Liability

No Liability for BAC Results: We are not liable for any actions you
take based on BAC estimates or any other data generated by the App.

No Warranties: The App is provided "as is" and we disclaim all
warranties, expressed or implied, including merchantability, fitness for a particular purpose, and
non-infringement.

Indemnification: You agree to defend, indemnify, and hold harmless
CheersCount and its developer(s) from all claims arising out of your
use of the App.
9. Termination
We may terminate or suspend your account and access to the App at any time, with or without notice, for
conduct violating these Terms or for any other lawful reason.
10. Changes to These Terms
We reserve the right to modify these Terms of Service at any time. If changes are material, we will
provide notice (e.g., in-app notification, email). Continued use of the App after changes are posted
constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with general principles of law applicable in
Austria and the EU, without regard to conflict-of-laws provisions.
